A California sublease agreement is used when a tenant renting a property wants to lease the property to someone else, a party typically known as a “subtenant.” Subleasing or subletting, as it is sometimes called, can face legal obstacles, and tenants will need to consult with their landlord prior to initiating a sublease agreement. In the event the landlord agrees to allow a sublease, the original tenant is responsible for making sure that the the subtenant hews to the terms of the original lease agreement. The original tenant also must pay rent if the subtenant does not.
